Terms of Service

1. Who we are

L'Importeur is a trade name of TAV GROUP LLC, registered in Wyoming, United States. We operate from Willemstad, Curaçao and provide vehicle sourcing, import, and delivery services to the ABC islands (Curaçao, Aruba, and Bonaire).

2. Services

We do not hold stock. You tell us the vehicle you want — make, model, year range, specification and budget — and we search our dealer networks in the United States and Europe on your behalf.

We then present you with at least 3 vehicles matching your brief. You choose one, we have it independently inspected, and only once you accept the inspection report do we purchase it. We then handle shipping, customs clearance, import duties, registration and delivery, with plates and registration in your name.

3. Pricing and payment

All prices listed on our website and in vehicle quotes are all-in prices. This includes the vehicle purchase price, shipping, marine transit insurance, import duties, sales tax, registration, and plates. There are no hidden fees.

Payment is made in three stages, each falling due only after the preceding step is complete:

1. Sourcing fee — $1200 USD. Paid when you ask us to begin searching. Refundable in full until we present your vehicles; see section 8.
2. Deposit — 10% of the vehicle price. Paid when you select one of the vehicles we present. It secures that vehicle and pays for its inspection, and is credited in full against your balance.
3. Balance. Due after you accept the inspection report, against a firm all-in quote. Your deposit is deducted. We purchase the vehicle once the balance is received.

All payments are made by bank transfer to the account named on your invoice. We never request payment through any other channel, and our bank details will never change mid-transaction by email.

4. Vehicle condition

The vehicle you select is independently inspected before we commit to buying it. You receive the full inspection report, photographs and service history, and we do not purchase until you have accepted that report. If the inspection reveals something you are not willing to accept, you are under no obligation to proceed.

We source pre-owned vehicles. Normal wear consistent with the vehicle's age and mileage is not a defect. Cosmetic details visible in the provided photographs are considered accepted at the time of agreement.

5. Shipping and delivery

Delivery timelines are estimates, not commitments. 3–6 weeks from purchase is typical depending on origin, but ocean transit is scheduled by the carrier and clearance is controlled by the customs authority. Delays caused by weather, port congestion, customs processing, dealer readiness or other factors outside our control do not constitute a breach of these terms.

All vehicles are covered by marine transit insurance during ocean transport. If damage occurs during shipping, the insurance policy covers repair or compensation. We document the condition of every vehicle before shipping and inspect it again upon arrival.

6. Import duties and taxes

Import duties and taxes are determined by the customs authority of the destination island and are calculated on the CIF value (vehicle cost plus insurance plus freight). While we include these in our all-in pricing, the rates are set by government and are subject to change. If duty rates change between the time of your quote and the time of customs clearance, any difference will be communicated to you.

7. Your responsibilities

You are responsible for providing accurate personal identification and residency documentation. A valid sedula (Curaçao), cedula (Aruba), or equivalent residency permit is required to import and register a vehicle for personal use. You are also responsible for arranging local motor vehicle insurance before delivery.

8. Cancellation and refunds

Sourcing fee. Refundable in full at any time before we present your vehicles. If we cannot find 3 vehicles matching your brief, you receive the entire fee back. Once we have presented them the fee is earned, whether or not you go on to buy — you have received the work you paid for.

Deposit. If the inspection is unfavourable, or you decide against the vehicle after reading the report, your deposit is returned. We retain only our share of the inspection cost — we pay 50% of it ourselves, because an inspection that finds a problem is the inspection doing its job. You may instead apply the deposit to another of the vehicles we presented.

After purchase. Once you have accepted the inspection report, paid the balance and we have purchased the vehicle on your behalf, the transaction is final. At that point the vehicle is bought and title is being transferred.

9. Limitation of liability

Our liability is limited to the services described in your vehicle quote. We are not liable for indirect, consequential, or incidental damages. Our total liability shall not exceed the service fee component of your transaction.

10. Governing law

These terms are governed by the laws of Curaçao. Any disputes arising from these terms or our services shall be resolved in the courts of Curaçao.

11. Changes to these terms

We may update these terms from time to time. The version posted on this page is the current version. Continued use of our services constitutes acceptance of the current terms.
